| dc.description.abstract | Cílem této práce je zmapování nestátních neziskových organizací (dále jen NNO) v rámci integrovaného záchranného systému (dále jen IZS) Středočeského kraje. Jaká je definice NNO a co je to dobrovolnictví. Práce řeší, jaké jsou právní formy NNO, analýza jejich stavu, způsobu jejich zapojování a nasazení při řešení mimořádných událostí (dále jen MU). Dále pak aktuálnost jejich smluvního vztahu a schopnost jeho plnění. Zda jsou schopni nasadit deklarované síly a prostředky. V práci jsou taktéž řešeny podrobné právní formy smluvních vztahů subjektů. Zdali se jedná o plánovanou pomoc na vyžádání dle zákona o IZS, zde je subjekt ostatní složkou IZS či jen dohody o spolupráci a z toho vyplívající práva a povinnosti subjektů.
Při řešení problematiky byly použity smlouvy a dohody se subjekty uzavřených se základními složkami IZS. Došlo k ověřování platnosti dohod a oslovením subjektů, byla zjišťována dostupnost a schopnost plnění předmětu dohod. Aktuálnost deklarovaných sil a prostředků. Dále bylo realizováno vyhledávání nových vhodných subjektů pomocí sítě internet, dotazováním u již začleněných subjektů, u základních složek IZS a pomocí rešerše ve zprávách o zásahu v systému statistik událostí IZS. V neposlední řadě byla využita osobní zkušenost autora a kontakty v oboru.
Nestátní nezisková organizace je organizace nezřizovaná státem a na státu nezávislá, která je určena k obecně prospěšné činnosti nebo k neziskové činnosti pro soukromý nebo veřejný prospěch. Nejčastěji užívanou právní formou jsou spolky, nadace nebo nadační fondy, církve nebo náboženské společnosti a dnes již nezřizované obecně prospěšné společnosti. Jejich činnost a podíl na fungování IZS není zanedbatelný. Provedeným výzkumem na právních odděleních bylo zjištěno, že dvě základní složky IZS, a to Policie České republiky (dále jen PČR) a Zdravotnická záchranná služba (dále jen ZZS) kraje nemají uzavřeny žádné dohody s NNO. Tyto složky řeší veškerou problematiku externí pomocí u zásahu prostřednictvím velitele zásahu, respektive Hasičského záchranného sboru (dále jen HZS) Kraje a jeho Krajského operačního a informačního střediska (dále jen KOPIS). U některých subjektů bylo zjištěno, že nejsou prakticky vůbec využívány. Zkoumané subjekty měli dohody platné a byly dle předmětu dohody ji připraveny plnit v uvedeném rozsahu. Místní skupina Vodní záchranné služby Českého červeného kříže (dále jen VZS ČCK) Kladno II, Klub vojenské historie Sanites Car Beroun, Help in Danger nebo Záchranný sbor ČR nejsou příliš nebo vůbec využívány. Pátráním bylo vyhledáno několik potencionálních nových subjektů. Bohužel většina z nich nesplňovala ani ty základní předpoklady pro uzavření dohody s IZS. Jedná se především o vhodnou náplň činnosti, pohotovost k výjezdu 24/7 nebo dostupnost a další garance. Jediným vhodným kandidátem, který po výzkumu zbyl, je Asociace dobrovolných záchranářů ČR, o. s. z Dobřichovic. Ta splnila všechny předpoklady pro správné a účelné fungování v IZS a bude přizvána k dalšímu jednání.
Na základě zjištěných údajů má IZS Středočeského kraje kvalitně podchyceny fungující NNO. Tento stav je pravidelně ověřován a dohody jsou aktualizovány. Některé subjekty nemají prakticky žádné využití a nejsou povolávány. Zde je otázka důvodnosti trvání smluv a tedy možnost jejich případného vypovězení. Při výzkumu bylo zjištěno, že další potenciál krom jednoho subjektu se v kraji nenachází. Z pohledu strany IZS, ať již HZS kraje či jiných složek, není ani vznesen žádný požadavek na doplnění subjektů. Všechny oblasti pro řešení MU jsou pokryty a dostatečně zabezpečeny. A to jak v poplachovém plánu kraje, tak i v havarijním plánu kraje. | cze |

| dc.description.abstract-translated | The aim of this thesis is to map non-governmental organizations (NGOs) within the Integrated Rescue System (IRS) of the Central Bohemian Region. The definition of NGOs and what is volunteering. The thesis describes what are legal forms of NGOs, analysis of their condition, the manner of their involvement and commitment in dealing with emergencies (the EM). Furthermore, the timeliness of their contractual relationship and the ability of its implementation. Whether they are able to deploy the nominal power and resources. The paper also dealt detailed legal forms of contractual relationships bodies. Whether it's planning to request assistance under the law on the IRS, there is an entity other components of the IRS or a Cooperation Agreement and the revenues resulting rights and obligations of the parties.
In addressing the issue were overviewed contracts and agreements entered into with entities with the basic components of the IRS. There was a validation agreements and addressing subjects was determined the availability and capability of performance of agreements. Actuality declared forces and resources. Further, a search for new suitable subjects via the internet, has included questioning of subjects with essential components of the IRS and using research in reports of intervention in the event of IRS statistics. Last but not least, the author used personal experience and contacts in the industry.
The NGO is an organization not organized by state and state independent, which is designed to charitable activities or for nonprofit activities for public or private benefit. The most commonly used legal form are associations, foundations or endowment funds, church or religious society and nowadays non public benefit corporations. Their work and contribution to the functioning of the IRS is not negligible. Research carried out by the Legal Department, it was found that the two basic components of the IRS, the Police of the Czech Republic (PCR) and the Emergency Medical Services (EMS) has not concluded any agreements with NGOs. These components solves all the problems with using external intervention through the commander, or the Firefighter's Rescue Squad (hereinafter referred to as FRS) region and its Regional Operational and Information Centre (hereinafter KOPIS). The investigated subjects had a valid agreement by the arrangement were ready to meet her in that range. Local Group Water Rescue Service of the Czech Red Cross (hereinafter WRS CRC) Kladno II, Military History Club Sanites Car Beroun, Help in Danger or Rescue Corps of the Czech Republic are not very or not at all used. Quest was searched several potential new entrants. Unfortunately, most of them did not meet even the basic requirements for an agreement with the IRS. It is mainly suitable filling activities, emergency exit for 24/7 availability and or other low. The only suitable candidate, who left after the research is voluntary rescuers Association of the Czech Republic, o.s. from Dobřichovice. It met all the prerequisites for the proper and efficient functioning of the IRS and will be invited to the next meeting.
Based on the data of the Central Region of the IRS has covered well functioning of NGOs. This condition is checked regularly and agreements are updated. Some operators have virtually no use and are not recruited. Here's the question the merits of the duration of the contracts and therefore the possibility of any termination. During the research it was found that other potential except for one subject is not in the county. From the side view of the IRS, either FRC or other components, is not put forward any request to supplement subjects. All areas of the MU solutions are covered and adequately safeguarded. And both alarmed plan of the region, as well as in regional emergency plan. | eng |
